Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters
Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters (Aarhus Convention) was signed on June 25, 1998 in Aarhus (Denmark) at the Fourth Pan-European Ministerial Conference “Environment for Europe”. Ukraine ratified Aarhus Convention on July 6, 1999.
According to the provisions of the Convention and in order to contribute to the protection of the right of every person of present and future generations to live in an environment adequate to his or her health and well-being, each Party shall guarantee the rights of access to information, public participation in decision-making, and access to justice in environmental matters in accordance with the provisions of this Convention (Article 1 of the Convention).
According to the Article 10, paragraph 2, of the Convention the Parties shall keep under continuous review the implementation of this Convention on the basis of regular reporting by the Parties.
At the first meeting of the Parties to the Convention which took place on 21-23 October 2002 in the town of Lucca in Tuscany, Italy it was adopted Decision 1/8 “Reporting Requirements” . According to this Decision the Parties are requested to prepare their reports through a transparent and consultative process involving the public and submit reports so as to arrive no later than 120 days before the meeting of the Parties for which they are submitted.
It is noted that public involvement in the process of reporting will improve the quality and accuracy of the reports and strengthen the credibility of the reporting process.
On November 25, 2005 by the Decree of the Ministry of Environment Protection of Ukraine a Working Group on drafting the National Implementation Report (NIR) was set up, its working plan having been approved. The NIR was drafted in the format proposed by the Convention Secretariat .
EcoPravo-Kyiv Environmental Law NGO assisted Ministry of Environment Protection of Ukraine to carry out public discussion of the draft NIR.
On January 24, 2005 Ministry of Environment Protection of Ukraine submitted the Aarhus National Implementation Report to the Convention Secretariat.
